A 341 Meeting, also commonly known as a meeting of creditors, is an opportunity for creditors and the bankruptcy trustee to ask the debtor questions. The meeting is called a 341 meeting because it is provided for in Chapter 11, Section 341 of the United States Code. Section 341 provides that a meeting must be held within a reasonable amount of time after filing. Commonly these meetings are set for approximately one month after the bankruptcy petition is filed with the court.

Section 341 also provides guidance to the trustee about what to ask the debtors. Among these include that the debtor is aware of the legal consequences of seeking a discharge, whether the debtor qualifies, and if the debtor understands the effect of reaffirming a debt versus obtaining a discharge of the debt. The trustee will generally ask about a debtor?s real and personal property. If the debtor owns a home the trustee is likely to ask the value of the home and how the debtor came to the value of the home. The trustee will also ask how much is owed against the home. The same questions will likely be asked regarding motor vehicles. The trustee may ask if the debtor is employed in the same capacity that he was at the time of filing.

Depending on what is listed in your schedules the trustee may ask follow up questions. For example, if a debtor lists a transfer of property or a business the trustee may want to know about those assets. The trustee may ask any questions and it is his job to ensure that if there is any property or money that should be turned over that it is in fact turned over to the bankruptcy estate.

The meeting of creditors provides an opportunity for the debtor to testify on the record concerning his or her bankruptcy petition and schedules. If there are any errors or omissions that have not been addressed the debtor should certainly mention the issues at this meeting. If there are errors or omissions the debtor may still need to amend schedules, however, it is imperative that this is mentioned at the creditors meeting. The bankruptcy petition and schedules are signed under penalty of perjury and testimony at the creditors meeting is offered under penalty of perjury.

The section 341 meeting, or meeting of creditors, is a very routine hearing that occurs in every bankruptcy case. Calorie Restriction Fails to Lengthen Lifespan in Primates

A new monkey study suggests that genetics and healthy diets might matter more for longevity than consuming a very low-calorie diet

To those who enjoy the pleasures of the dining table, the news may come as a relief: drastically cutting back on calories does not seem to lengthen lifespan in primates.

The verdict, from a 25-year study in rhesus monkeys fed 30% less than control animals, represents another setback for the notion that a simple, diet-triggered switch can slow ageing. Instead, the findings, published this week in Nature1, suggest that genetics and dietary composition matter more for longevity than a simple calorie count.

?To think that a simple decrease in calories caused such a widespread change, that was remarkable,? says Don Ingram, a gerontologist at Louisiana State University in Baton Rouge, who designed the study almost three decades ago while at the National Institute on Aging (NIA) in Bethesda, Maryland.

When the NIA-funded monkey study began, however, studies of caloric restriction in short-lived animals were hinting at a connection. Experiments had showed that starvation made roundworms live longer. Other studies had showed that rats fed fewer calories than their slow and balding brethren maintained their shiny coats and a youthful vigour. And more recently, molecular studies had suggested that caloric restriction ? or compounds that mimicked it ? might trigger a cascade of changes in gene expression that had the net effect of slowing ageing.

In 2009, another study2, which began in 1989 at the Wisconsin National Primate Research Center (WNPRC) in Madison, concluded that caloric restriction did extend life in rhesus monkeys. The investigators found that 13% of the dieting group died from age-related causes, compared with 37% of the control group.

One reason for that difference could be that the WNPRC monkeys were fed an unhealthy diet, which made the calorie-restricted monkeys seem healthier by comparison simply because they ate less of it. The WNPRC monkeys? diets contained 28.5% sucrose, compared with 3.9% sucrose at the NIA. Meanwhile, the NIA meals included fish oil and antioxidants, whereas the WNPRC meals did not. Rick Weindruch, a gerontologist at the WNPRC who led the study, admits: ?Overall, our diet was probably not as healthy.?

Further, the WNPRC control group probably ate more overall, because their meals were unlimited, whereas NIA monkeys were fed fixed amounts. As adults, control monkeys in the WNPRC study weighed more than their NIA counterparts. Overall, the WNPRC results might have reflected an unhealthy control group rather than a long-lived treatment group. ?When we began these studies, the dogma was that a calorie is a calorie,? Ingram says. ?I think it?s clear that the types of calories the monkeys ate made a profound difference.?

Researchers studying caloric restriction in mice have become accustomed to mixed results, which they attribute to genetic diversity among strains. Genetics probably explains part of the variation between the monkey studies, too, as the NIA monkeys were descended from lines from India and China, whereas the Wisconsin monkeys were all from India.

The molecular effects of caloric restriction have also turned out to be complicated. Using compounds such as resveratrol, found in red wine, scientists have triggered the stress response that caloric restriction activates, which shuts down non-vital processes in favour of those that ward off disease. But hopes that ageing could be delayed by targeting a single gene or protein in a single molecular pathway have faded, as researchers have learned that the key pathways vary according to the animal.?It may take us a decade to sort out longevity networks,? says David Sinclair, a geneticist at Harvard Medical School in Boston, Massachusetts.

As the technology behind popular printers, like the popular Dell all in one printers becomes ever more sophisticated, it is increasingly easier for the average customer to become lost in the constant stream of updates, configurations, capabilities and features of a product whose manufacturers consistently strive to one-up each other.

There is no standard for determining what makes one printer better than another. Ultimately, the decision to go with a certain product will depend on a combination of the features most desirable for each individual customer. For example, a typical family of four would not care much about print speed or whether or not the photographs a certain printer produces are of professional quality, but affordability and ease of maintenance might be primary concerns.

Additionally, small business owners might look more heavily into the faxing and emailing capabilities of all in one printers and care less about the scanning function; an amateur historian or small-town journalist might care very deeply about the quality of scans a certain machine delivers.

Some amateur or professional photographers do not have the time or materials or simply don't want to upload pictures to a computer, save them and then print them out. For these people, printers that can print directly from a digital camera via PictBridge or a similar device aren't just convenient, they're necessary.

Even if a printer is old, it may have the opportunity to be upgraded through cutting-edge applications sold online by the printer's manufacturer. Unfortunately, many don't have that opportunity. If it's important to keep a printer up to date, this capability becomes a primary concern.

Just as with their customers, each printer is unique. In most cases, it's not a matter of better or worse, but what's right for the customer. Before buying an all in one printer, a savvy customer will first find out what specs he or she desires in a product, and make the decision based on that.

3-D Printing Revolution Stymied For Now by High Prices

A product developer aims to develop a 3-D printer that would help to push the price to consumers down to about $1,000 in the near future

Three-D printers have the potential to spark a revolution of creativity and self-sufficiency.

It looks like this: you use your last drywall anchor in the middle of a shelving project and, instead of running to the hardware store, you turn on the printer. You design a nightlight in the shape of your child?s favorite animal and you turn on the printer. You need a spare house key and you turn on the printer. It?s going to happen, but there?s one big thing holding us back. Today, a decent 3-D printer costs at least $1,500.

A price tag alone can delay a revolution.

Two reasons caused regular computer printers to catch on?a development that took more than thirty years: The cost went down far enough that most could afford to buy one and printing shops opened up for those who couldn?t. The same changes are already starting to occur in the world of 3-D printing.

Bringing down prices
This month, Matt Strong, a product developer in Pleasant Grove, Utah, started a campaign on Kickstarter to build and sell a clone of the MakerBot Replicator, one of the most popular 3-D printers on the market for hobbyists. He?s altering the design a bit here and there and renaming it the TangiBot, but the biggest change is the price. He wants to sell his machine for nearly a third less money than MakerBot.

The Replicator?s design is licensed as open-source hardware and it?s available for anyone to see and use. ?All the data was there in some form, but I had to go through and clean it up and verify the materials,? says Strong.

The main thing he wanted to do was find a cheaper way to produce it, namely by setting up an assembly line in China.

Critics have accused Strong of working against the spirit of open source by trying to resell a product without contributing anything to its design. However, Strong says that he is applying creativity where it is most needed?in the printer?s manufacturing.

?The way something is assembled is absolutely additive. That?s how prices come down,? he says. ?A lot of people want to see the project taken down. I?m not going to do that.?

Strong has caused some alarm in the open-source community (though MakerBot itself has maintained a diplomatic silence). So far, he has reached less than 10 percent of his funding goal on Kickstarter. But even if his project fails, he has loudly declared that the MakerBot could be manufactured for less, and it?s only a matter of time before someone does it.

A lesson from history

Such a development could very well push the price down to about $1,000 in the near future, which is the same amount you would have paid for Hewlett Packard?s first personal DeskJet in 1988. At that price, HP was able to sell enough printers to awaken a whole new market and from there on out prices plummeted. Those who still could not afford to buy a printer benefited from a relatively new service. By the nineties, Kinko?s copy stores were selling printouts by the page.

This trend is just emerging with 3-D printing. A passerby looking through the window into Diane?s Mail Room, a shipping provider in Buckley, Wash., can see the 3D Touch, a $4,000 double-headed 3-D printer, next to the laser printers and inkjets.

?We?re probably the most innovative mailbox store you?ve ever seen,? says owner Ted Griffiths. ?We?re probably the only retail store in America that?s got one.?

ALJ Gildea Rules On Motions In Limine In Certain ... - ITC Law Blog

On August 17, 2012, ALJ E. James Gildea issued the public versions of Order No. 60?(dated July 26, 2012), Order No. 62 (dated July 30, 2012), and Order No. 67 (dated August 2, 2012) regarding various motions in limine filed by Complainant Apple Inc. (?Apple?) in Certain Portable Electronic Devices and Related Software (Inv. No. 337-TA-797).

By way of background, the investigation is based on a July 8, 2011 complaint alleging violation of Section 337 in the importation into the U.S. and sale of certain portable electronic devices and related software that infringe certain claims of U.S. Patent Nos. 7,844,915 (?the ?915 patent?); 7,469,381; 7,084,859 (?the ?859 patent?); RE 42,738 and 7,920,129 (?the ?129 patent?) (collectively, ?the asserted patents?).? The respondents in this investigation are HTC Corp., HTC America, Inc., and Exedea, Inc. (collectively, ?HTC?).? See our July 11, 2011 post for more details.

In Order No. 60, ALJ Gildea ruled on Apple?s motion in limine to preclude three of HTC?s experts from testifying regarding (i)the doctrine of prosecution history estoppel, (ii) whether certain claims of the asserted patents were narrowed during prosecution, and (iii) the effect of any narrowing with regard to the doctrine of equivalents. Apple argued it would be improper and prejudicial for the experts to opine on matters of law as they do not have specialized knowledge, experience, or expertise that would enable them to offer reliable opinions regarding the effect of such amendments.

HTC opposed the motion, alleging its experts are entitled to testify regarding the facts and substance of these amendments, the resulting change in claim scope, and the fact that Apple?s proposed equivalents were foreseeable when the amendments were made. HTC added that the testimony relates to underlying factual issues that inform the prosecution history estoppel analysis and leaves the ALJ to decide the legal effect.

The Commission Investigative Staff (?OUII?) supported Apple?s motion in-part, arguing that HTC?s experts should be permitted to testify from the perspective of a person of ordinary skill in the art as to whether the patent applicants narrowed the scope of their invention, but should not be permitted to testify on the ultimate legal question of whether a presumption of estoppel exists.

After considering the parties positions, ALJ Gildea denied the motion noting that the Federal Circuit has held that this type of testimony is relevant to a factual inquiry for which expert testimony is appropriate, thereby allowing testimony as to whether the amendments narrowed the scope of the invention from the perspective of a person of ordinary skill in the art and whether any alleged equivalents were foreseeable at the time. As to the testimony on the ultimate legal issue regarding the effect of any amendments, the ALJ finds the motion premature, stating that the parties could make timely and appropriate objections at the evidentiary hearing.

In Order No. 62, the ALJ ruled on Apple?s motion in limine to preclude certain claim construction testimony by one of HTC?s experts, Dr. Bederson, that it alleged would conflict with ALJ Gildea?s claim construction order, Order No. 57. For more details on this claim construction order, see our July 31, 2012 post. Specifically, Apple asserted that Dr. Bederson attempts to construe the term ?the event object invokes? of the ?915 patent by further construing the term ?event object? to require that it be able to ?execute methods or functions for scrolling and scaling.? HTC, Apple argued, voluntarily waived construing this phrase during the Markman process. Apple also asserted that Dr. Bederson ignores the parties? agreed constructions and injects a requirement of ?identification? in certain claims of the ?859 patent, despite ALJ Gildea?s rejection of an identification requirement in relation to the ?pinch or bracket? limitation of these claims.

HTC opposed the motion, arguing that Dr. Bederson?s opinions are related to the plain and ordinary meaning to a person of ordinary skill in the art, specifically, to the plain and ordinary meaning of ?invoke? and ?pinch.? HTC added that Apple?s objection was untimely, as Dr. Bederson addressed this issue in his March 26, 2012 report.

The OUII supported Apple?s motion in-part, asserting that HTC should not be permitted to offer arguments or testimony regarding the scope of terms to the extent that such claim constructions are inconsistent with Order No. 57. The OUII added, however, that HTC should not be precluded from offering evidence simply because Apple alleges that it relates to a new claim construction and the ALJ should determine whether the evidence is relevant under the issued claim constructions.

After considering all submissions, the ALJ granted Apple?s motion in-part, determining that HTC should not be permitted to offer argument or testimony that would be inconsistent with the claim constructions of Order No. 57 and that no party would be permitted to advance constructions for claim terms addressed in that Order. Specifically, as to ?event object invokes? of the ?915 patent, the ALJ found that Dr. Bederson was not trying to further construe the term ?event object,? but rather was attempting to advance a construction for the word ?invoke? which was not addressed in Order No. 57. As such, ALJ Gildea ruled that any evidence and testimony attempting to construe the term ?invokes? in the phrase ?event object invokes? should be precluded. Regarding ?pinch or bracket displayed data? of the ?859 patent, the ALJ found that Order No. 57 did not address whether the ?859 patent requires a ?pinch? or ?identification? of data. Thus, the parties were not precluded from presenting evidence or testimony as to whether ?identification? was required prior to further manipulation of the data.

In Order No. 67, ALJ Gildea ruled on Apple?s motion in limine to preclude three of HTC?s experts from introducing evidence, argument, or testimony that was not properly disclosed in their expert reports and deposition testimony. Specifically, Apple requested that HTC be precluded from offering evidence or argument relating to prior art combinations not timely disclosed, new invalidity arguments, and new non-infringement arguments. Regarding the undisclosed prior art combinations, Apple asserted that HTC?s expert reports merely included a laundry list of references that could be combined with various other references to render the claims obvious, but failed to meaningfully disclose the way specific combinations of prior art would render the asserted claims obvious.

Thus, Apple reasoned, HTC should? be precluded from offering any evidence regarding any 103 prior art combinations. As to the alleged new invalidity arguments, Apple asserted that, when writing its prehearing brief, it relied on communications from HTC including a narrow list of prior art which HTC intended to include in its brief with regard to the validity of the ?129 patent. However, in its briefing, HTC included additional references outside those listed in the letter. Accordingly, Apple requested that HTC be precluded from presenting evidence regarding these invalidity contentions. Apple also requested that HTC be precluded from presenting evidence on additional new invalidity arguments first disclosed in the brief and new non-infringement arguments first disclosed in the brief for which HTC failed to provide requested discovery.

HTC opposed Apple?s motion. As to the prior art combinations Apple argued were undisclosed in the expert reports, HTC asserted the expert reports did discuss each combination of prior art and that Apple should have raised any concerns as to these reports earlier. With respect to the communications from HTC to Apple, HTC argued that Apple?s reliance was misplaced and that HTC indicated its anticipation references and obviousness combinations could change and that, although it indicated it would not be using a particular reference, Philipp, as an anticipating reference or as the primary reference in certain obviousness combinations, those combinations did not include those Apple now seeks to preclude. Regarding Apple?s new invalidity and infringement allegations, HTC stated that these arguments were in-fact disclosed previously, that HTC did provide discovery related to the non-infringement arguments, that Apple?s motion does not identify which discovery is missing, and that Apple?s untimely discovery dispute is inappropriate for resolution in a motion in limine.

The OUII supported Apple?s motion in-part, supporting the motion to the extent that new prior art combinations or new details about previously disclosed contentions were raised in HTC?s brief or during the hearing. The OUII opposed the motion to the extent that these combinations and contentions were disclosed in the expert reports. Specifically, with regard to the discovery issue, the OUII opposed the motion stating that Apple had not shown any evidence that it requested discovery on the issue or pursued a motion to compel such discovery.

After reviewing the submission, the ALJ granted Apple?s motion in-part. As to Apple?s dispute regarding the sufficiency of the prior art combinations disclosed in the expert reports, ALJ Gildea ruled that Apple?s requested relief, the barring of HTC from presenting any obviousness combinations, would go too far and was unwarranted. Thus, the ALJ denied this portion of the motion, stating that any appropriate supported objection could be raised during the hearing should the experts introduce new opinions or expand upon opinions that fall outside the scope of their reports and deposition testimony. With respect to Apple?s dispute about the HTC communications, the ALJ did not find sufficient language to put Apple on notice that the list of references and combinations could change without notice and found it reasonable that Apple concluded that HTC did not intend to rely on the combinations with Philipp at issue in the motion. ALJ Gildea, accordingly granted this portion of the motion, ruling that HTC should be precluded from presenting evidence on combinations of references that were not included in the communications at issue. The ALJ clarified, however that HTC was not precluded from offering evidence on any reference with respect to the state of the art, secondary considerations, or motivation to combine as HTC reserved its right to do so in those communications.

Finally, as to the alleged new invalidity and infringement allegations, the ALJ found that these arguments were not new, rather they were addressed in the appropriate expert report. As to the discovery issue, ALJ Gildea agreed with the OUII that Apple had not shown that it requested discovery on the issue or pursued it with a motion to compel. Therefore, the ALJ denied these aspects of Apple?s motion.

European court nixes Italy embryo screening ban

(AP) ? Italy's ban on screening embryos for diseases before they are implanted in a womb violates the rights of a couple whose first child was born with cystic fibrosis, the European Court of Human Rights ruled Tuesday.

The court's finding in favor of the Italian couple triggered fresh calls among Italian politicians for a less restrictive law regulating artificial procreation.

Following fierce lobbying by pro-Vatican centrist parties, Italy's Parliament passed a law in 2004 that allows couples to use in vitro fertilization for infertility but bans pre-implantation diagnosis of embryos. Vatican teaching forbids artificial procreation methods.

The court concluded it was "inconsistent" that Italians could abort a fetus with defects but not test an embryo before implantation, as the couple had wanted to do. The couple who challenged the law before the Strasbourg court had discovered they are healthy carriers of cystic fibrosis when their daughter was born in 2006 with the inherited disorder.

When the mother became pregnant again in 2010, she had the fetus aborted when it was found to have cystic fibrosis. The couple then hoped to use medically-assisted procreation with genetic screening to avoid transmitting the disease to their children. But Italy's law forbids that, so they took their quest to the court.

The court noted that the Italian government was trying to "avoid the risk of eugenic abuses" with the law but said it interfered with the couple's "right to respect for their private and family life."

Italy has one of Europe's strictest rules for artificial procreation. It bans the donation of eggs or sperm as well as the use of surrogate mothers, and limits infertility treatment to heterosexual couples who are married or who have been living together for several years.

Italian lawmakers said it was time to change the law.

"(This ruling is the) latest confirmation of the unconstitutionality of this law, which doesn't at all protect the rights and health of citizens," said Antonio Palagiano, a lawmaker with the centrist Italy of Values party.

Similar statements came from Parliament's two largest parties, one from the center-right, the other from the center-left.

In 2009, Italy's Constitutional Court struck down one of the most contested sections of the law, which had said that only three embryos could be created at one time and that all three must be implanted.

The law was passed under conservative leader Silvio Berlusconi but even his allies urged Tuesday that it be revised.

"It's further demonstration of the fact that forcing a law, often determined through ideological reasons in one sense or another, never works," said Fabrizio Cicchitto, one of Berlusconi's closest political allies.

Central bank, growth concerns halt share gains

LONDON (Reuters) - A month-long rally in world shares and riskier currencies such as the Australian dollar stalled on Tuesday as uncertainty over global growth and the next moves by the world's major central banks put investors in a cautious mood.

However, the threat of a tropical storm in the Gulf of Mexico hitting oil supplies supported crude prices, while Wall Street looked set to open unchanged ahead of a key speech by Federal Reserve Chairman Ben Bernanke on Friday. <.n/>

Major risk asset markets have enjoyed broad-based gains over the past month due to hopes for a third round of monetary easing by the Fed and a promise from the European Central Bank President Mario Draghi to do everything needed to save the euro.

But after the rallies, which saw the euro touch a seven-week high on Thursday of $1.2590, investors are looking for more clarity on the next steps.

"Markets have priced in too much optimism of late which has seen traders finally question the likelihood of central banks delivering on what the market had led itself to believe would happen," said Andrew Taylor, market strategist at GFT Global.

Growth worries returned to haunt the markets after Japan's government cut its forecast for the economy, citing slowdowns in the United States and China, as well as Europe's debt crisis.

This followed a weak August reading of business sentiment in Germany on Monday and last week's purchasing managers reports, which painted a picture of economic malaise stretching from Beijing to Berlin.

The price of iron ore, coal and other commodities have fallen sharply in reaction to concerns about the world economy, and the commodity-linked Australian dollar hit a fresh five-week low of $1.0345.

Adding to signals of weakness, Spain said on Tuesday that its recession had deepened in the second quarter as domestic spending slumped in the wake of tough austerity measures aimed at tackling the government's fiscal problems.

STIMULUS EYED

Investors were looking ahead to Friday's speech by Fed Chairman Bernanke at an annual meeting of central bankers at Jackson Hole, Wyoming, for any signals that more monetary easing is the works.

Bernanke's widely anticipated speech comes as expectations for a so-called QE3 have increased since minutes from the central bank's August policy meeting were released, even though there has been an improvement in U.S. data since that meeting.

However, the ECB Draghi's is no longer planning to attend the conference due to a heavy workload - a decision which triggered a sudden surge in the value of the euro to a day's high of $1.2563. Gains were seen limited though.

The Jackson Hole retreat comes just as ECB policymakers are hammering out the details of a new bond-buying plan aimed at tackling the euro zone debt crisis.

Uncertainty about how the scheme will work and whether it will ease the funding crisis facing many key euro zone governments, like Spain and Italy, has added to the cautious tone in risk asset markets.

Top ECB policymaker Joerg Asmussen said on Monday the plan would ensure countries whose bonds the central bank bought did not soft-pedal on reforms. He did not say when the bank would begin buying, but did make clear the plan would go ahead despite opposition from Germany's Bundesbank.

"The newsflow out of the ECB still leaves a lot of room for surprises, both on the upside and on the downside," said Elwin de Groot, senior market economist at Rabobank.

"Markets want to see strong commitment from the ECB that it is willing and able to pin down (Spanish and Italian) yields to levels much lower than they have been at lately," he said.

Ten-year German government bond yields were flat at 1.34 percent but this could change on Thursday when Italy will sell up to 6.5 billion euros ($8.1 billion) of new five- and 10-year bonds. A poor sale in Rome could prompt more investors to seek safety in Germany.

This will be the first auction of longer-term Italian debt since ECB President Mario Draghi said in late July he was ready to do whatever it took to preserve the euro.

His comments provoked a 14 percent rally in the euro zone's blue-chip stock index, the Euro STOXX 50 <.stoxx50e>, but this index was retreating on Tuesday, mirroring overnight losses in Asia, on the uncertain growth outlook.

Global shares, as measured by the MSCI world equity index <.miwd00000pus>, were also lower on the economic worries, falling 0.6 percent to 323.73 points and on track for a fifth straight day of losses.

Oil prices were holding steady with Brent crude around $113 a barrel as markets watched the progress of Tropical Storm Isaac towards the oil rigs and production facilities in the Gulf of Mexico.

"Because U.S. Gulf Coast refiners are operating near full utilization, the potential for disruption to oil product markets is particularly pronounced," J.P. Morgan analysts, led by Colin Fenton, said in a report.

Gold joined other risk assets in edging lower after rising to its highest in over four months in the previous session, as caution prevailed ahead of the Wyoming central bankers meeting.

Spot gold edged down 0.2 percent to $1,660.10 an ounce, having risen to $1,676.45 on Monday, its highest level since mid-April. ($1 = 0.7990 euros)

"Manufacturers started to offer better leasing options to get people into the new vehicles, because there was starting to be a shortage of used vehicles," says Bob Nicks, indirect senior lending consultant at Dupaco Community Credit Union. "It doesn't work for everybody, but it really can be a good tool for some."

The popularity of leasing ? when the driver pays for use of the vehicle ? is on the rise. Almost 20 percent of today's buyers lease a car rather than take out a loan, according to the Home & Family Finance Resource Center.

Monthly lease payments are typically smaller. But the buyer turns in the vehicle at the end of the contract, based on a set number of miles and period of time, leaving him with no equity in the vehicle.

Another option, Dupaco's Mini-Max Auto Loan, offers the benefits of leasing with the advantages of ownership.

Before you decide how to finance your next vehicle, weigh the benefits and drawbacks of each option:

  • Do you plan to keep the vehicle short-term or long-term? If you like to get a new vehicle every two to three years, leasing might be the better route. When you lease, your intention should be short-term (36 months or less), when the vehicle is still under warranty and is least likely to need repairs. If you plan to keep the vehicle beyond that, you might be better off purchasing it to avoid wear-and-tear-related expenses that can come with leasing.
  • Leasing can offer a tax advantage. You usually pay a tax on the portion of the vehicle that you're using, rather than the full purchase price.?
  • Consider leasing if you plan to use the vehicle for business. Often, you can deduct leasing costs as a business expense. "Always talk to your accountant first to see if you can do it," Nicks says.

But what exactly is going on between the ears when those warm and fuzzy feeling wash over us? A study published earlier this year revealed that love actually acts like an addictive drug. Hmmm, it seems that Ke$ha also got it right...

Researchers at Stony Brook University in New York examined the neural correlates of intense, long-term love using functional magnetic resonance imaging (fMRI) in 10 women and seven men. fMRI measures brain activity as a function of changes in blood flow. The participants, married an average of 21 years, underwent imaging while viewing either an image of their partner's face, or a familiar acquaintance.

Compared to viewing the acquaintance, areas specifically activated when viewing their spouse included:

? Regions of the dopamine-rich reward system, including the ventral tegmental area (VTA), dorsal striatum, and basal ganglia?areas that, interestingly, are implicated in early-stage passionate love. This "pleasure center," lead researcher Lucy Brown explains, "helps us recognize when something feels good."

? Regions implicated in maternal attachment, including: globus pallidus (GP), substantia nigra (SN), Raphe nucleus, thalamus, and insula.

Co-author Arthur Aron notes, "Intense passionate love uses the same system in the brain that gets activated when a person is addicted to drugs."

Tiffany lowers outlook as shoppers remain cautious

NEW YORK (AP) ? Upscale jewelry chain Tiffany & Co. lowered its outlook for the year on Monday as the wealthy cut back on buying baubles in an uncertain economy.

Company shares rose more than 7 percent Monday, however, as revenue in established stores, a key measure for retailers, declined less than analysts had expected in the second quarter. Investors may also have been encouraged that Tiffany is planning stores in new cities despite its challenges.

The affluent had been spending more since the Great Recession ended in mid-2009, recovering faster than other people. But starting late last year, Tiffany's customers trimmed their spending on jewelry amid stock market volatility and growing worry about the debt crisis in Europe.

"Not surprisingly, sales growth has been affected by economic weakness in a number of markets," said CEO Michael J. Kowalski. "We think it is only prudent to maintain a cautious near-term outlook about global economic conditions and the effects on customer spending."

Tiffany, known for its blue boxes, earned $91.8 million, or 72 cents per share, for the period ended July 31, up 2 percent from $90 million, or 69 cents per share, a year earlier.

Analysts expected earnings of 74 cents per share.

Revenue for the New York company rose 2 percent to $886.6 million from $872.7 million. Wall Street forecast $891.1 million.

Sales in the Americas edged down 1 percent to $434 million. Sales in the New York flagship stores fell 9 percent, after a 41 percent increase a year ago, because U.S. customers are spending less, said Tiffany spokesman Mark Aaron. Sales in U.S. stores to foreign tourists were roughly unchanged from the prior year as more Chinese visitors helped offset a decline in spending by European tourists in the U.S.

Japan's sales increased 11 percent to $159 million, while sales in the Asia-Pacific region, a once hot area, rose just 1 percent $174 million. European sales fell 1 percent to $100 million.

Overall, revenue at stores opened at least a year fell 1 percent. Analysts surveyed by FactSet had expected a 4 percent drop.

The company also continues to grapple with high costs for silver and gold, which have eroded its profitability. However, those costs have moderated a bit.

Still, Tiffany is determined to fortify its competitive edge.

It now plans to open 28 company-operated stores this year compared with the previously planned 24. In the second half, Tiffany plans a store in Manhattan's Soho neighborhood, a second store in San Francisco, a shop in La Jolla, Calif., a store in Rio de Janeiro and a third store in Toronto.

Tiffany said that it now expects 2012 earnings of $3.55 to $3.70 per share, down from $3.70 to $3.80 per share. Analysts predict $3.65 per share.

It also trimmed its revenue forecast to growth of 6 to 7 percent for the year, or about $3.86 billion to $3.89 billion. Its prior guidance was for a 7 to 8 percent increase. Analysts expect revenue of $3.87 billion.

Tiffany's stock gained $4.33, or 7.4 percent, to $62.83 in midday trading Monday.

Apple wins $1bn in patent suit against Samsung

Apple won more than $1 billion in a massive victory Friday over South Korean giant Samsung, in one of the biggest patent cases in decades -- a verdict that could have huge market repercussions.

Samsung Electronics said it would contest the verdict.

"We will move immediately to file post-verdict motions to overturn this decision in this court and if we are not successful, we will appeal this decision to the Court of Appeals," it said in a statement.

A jury in San Jose, California rejected Samsung's counterclaims against Apple, according to media reports -- a big win for the Silicon Valley giant, which had claimed its iconic iPhone and iPad had been illegally copied.

The jury, which had examined infringement claims and counter-claims by Apple and Samsung, ruled the South Korean electronics giant had infringed on a number of patents, the tech websites Cnet and The Verge said in live courtroom blogs.

The verdict affects patents on a range of Samsung products including some of its popular Galaxy smartphones and its Galaxy 10 tablet -- devices alleged to have been copied from the iPhone and iPad.

"This is a huge, crushing win for Apple," said Brian Love, a professor of patent law at Santa Clara University.

"All of its patents were held valid, and all but one were held to be infringed by most or all accused Samsung products. Even better for the company, five of the seven patents were held to be willfully infringed by Samsung."

Love said this means that Judge Lucy Koh "now has the discretion to triple Apple's damages award, which is already a monstrous and unprecedented $1.051 billion."

Technology analyst Jeff Kagan said of the verdict: "This is a great day for Apple. And it will turn into a very expensive day for Samsung."

Kagan said it was not immediately clear if Samsung would be able to continue to use the technology and pay Apple for the right to do so, or if they must pull their devices and redesign them.

In any case, the verdict in the case -- one of several pending in global courts -- is likely to have massive repercussions in the hottest part of the technology sector, smartphones and tablets.

Even a delay in sales could endanger Samsung's position in the US market, where it is currently the top seller of smartphones.

A survey by research firm IDC showed Samsung shipped 50.2 million smartphones globally in the April-June period, while Apple sold 26 million iPhones. IDC said Samsung held 32.6 percent of the market to 16.9 percent for Apple.

The jury reached its verdict after deliberating for less than three days, examining claims of infringement by both sides. The trial heard evidence during 10 days over a three-week period.

Samsung had steadfastly denied the charges by Apple, claiming it developed its devices independently, and countersued in the case, seeking more than $400 million for infringement on its wireless patents.

The verdict came the same day a South Korean court ruled Apple and Samsung infringed on each other's patents on mobile devices, awarding damages to both technology giants and imposing a partial ban on product sales in South Korea.

The court banned sales in South Korea of Apple's iPhone 4 and iPad 2, as well as Samsung's Galaxy S and Galaxy SII among other products.

Fierce fighting in Syria swells refugee exodus

AMMAN (Reuters) - Syrian troops forced rebels to abandon a battered Damascus suburb on Friday in the latest battle of an intensifying civil war that the U.N. refugee agency said had prompted more than 200,000 people to flee the country.

Hundreds of soldiers and dozens of tanks and armored vehicles pushed into the centre of Daraya after a small group of defenders withdrew, opposition activists said.

President Bashar al-Assad's forces had subjected the Sunni Muslim township to a three-day bombardment from artillery, tanks, mortars, rockets and helicopter gunships in which at least 70 people were killed, 21 of them on Friday they said.

"There are lots of bodies trapped in destroyed buildings and civilians are trying to flee towards Damascus," an activist in Daraya, who gave his name as Abu Kinan, told Reuters by phone.

"The rebels have mostly slipped away. The fear now is that the army will round up young men and summarily execute them, like it did in Mouadamiya," he said, referring to a nearby suburb where residents said troops killed at least 40 people in cold blood this week after storming in to hunt down rebels.

Opposition sources reported a similar killing spree by Assad's forces in the Qaboun district of Damascus, where they said at least 46 people were done to death.

Syrian authorities restrict media access, making it hard to verify accounts by both sides in the conflict.

More than 90 people were killed across Syria on Friday, including 22 civilians in the eastern province of Deir al-Zor, according to the opposition Syrian Observatory for Human Rights, which said about 220 had been killed nationwide on Thursday.

The incessant violence has accelerated a refugee exodus, with more than 3,500 Syrians fleeing to Turkey in the past 24 hours in what Turkish officials said was one of the highest daily totals since a revolt against Assad erupted in March 2011.

"In Jordan, a record 2,200 people crossed the border overnight and were received at Zaatari camp in the north," Adrian Edwards, spokesman for the U.N. High Commissioner for Refugees, said in Geneva.

ALEPPO FIGHTING

Assad's forceful response to initially peaceful protests inspired by Arab uprisings in Tunisia, Egypt and elsewhere has spawned an armed rebellion and plunged Syria into a civil war that the United Nations says has cost more than 18,000 lives.

The military has been struggling to shore up Assad's grip on Damascus and the northern city of Aleppo, which had long stayed aloof from the conflict between a mostly Sunni opposition and a power structure dominated by minority Alawites.

Fighting erupted in Aleppo, Syria's biggest city, after rebels staged an offensive there and in Damascus, emboldened by a July 14 bomb attack that killed four of Assad's top aides.

Clashes raged on in Aleppo, where combat jets and helicopter gunships struck rebel-held districts overnight, residents said.

One school used as a base by rebels was bombed twice during the night. "The rebels stay in abandoned police stations and hospitals, but the army knows exactly where they are," said Abu Ahmed, a resident living nearby.

On a frontline in the southern Saif al-Dawla area, rebels destroyed an armored personnel carrier and the army fired tank shells and mortar bombs, but made no attempt to advance.

The body of a civilian named Mohammed Tabraji, 25, lay in the street. His friend Mohammed al-Arabi said they had been looking for a place to buy bread when a sniper shot Tabraji.

In Bustan al-Qasr, not far from the frontline, a 20-year-old student who gave his name as Abdelrahman said his family was too poor to leave the city and hated the idea of fleeing to Turkey.

"If you go as a refugee you won't get any respect," he said. For most people here, self-respect is the most important thing."

SAFE HAVEN

Nonetheless, Syrians in dire straits have been streaming into neighboring Turkey, Jordan, Lebanon and Iraq.

Turkey alone now hosts more than 78,000 Syrian refugees, according to its Disaster and Emergency Management Directorate, a sharp rise on the 44,000 registered there at the end of July.

Ankara, saying it will not be able to accommodate more than 100,000 refugees, has suggested that the United Nations set up a safe haven inside Syria to staunch the outflow.

The chances of gaining a U.N. Security Council mandate for such a safe haven, which would require military protection, are close to zero, given the rejection by veto-wielding powers Russia and China of any outside intervention in Syria.

French Defence Minister Jean-Yves Le Drian said on France 24 television on Thursday that an "international coalition" of Western nations and allies could consider setting up a limited no-fly zone over part of Syria without such a mandate.

"The scenario mentioned by (U.S. Secretary of State) Hillary Clinton of a particular zone where there could be a banned area is something that needs to be studied," said Le Drian, the first senior French official to air the possibility of action by an "international coalition," rather than the United Nations.

On Tuesday, Russia warned the West against taking any unilateral action in Syria, after President Barack Obama threatened "enormous consequences" if Assad used Syria's chemical or biological weapons.

France chairs a meeting of U.N. Security Council foreign ministers in New York next week which it has said will focus on humanitarian solutions for Syrians caught up in the conflict.

Foreign Minister Laurent Fabius said he had invited Turkey, Iraq, Lebanon and Jordan to attend the conference, given the number of refugees and fears of the conflict spreading.

At least three people, including a Sunni Islamist commander, were killed on Friday in a fifth day of Sunni-Alawite fighting in Lebanon's northern city of Tripoli, where the bloodshed in Syria has aggravated old sectarian tensions.

A Lebanese security source said the Tripoli violence, in which 16 people have been killed this week, was "alarming and dangerous .. It is very likely that it will escalate this time".
